Grower Agreement
DAHLIA TUBER GROWER PARTNERSHIP AGREEMENT - A copy of this agreement will be emailed to you as part of your welcoming on-boarding package
This Dahlia Tuber Grower Partnership Agreement ("Agreement") is entered into as of today, by and between:
The Dahlia Tuber Collection, located at 8328 Chalet Drive, Whistler BC V8E 0G3 ("Company"),
and
[Grower Name] ("Grower").
Together, the Company and Grower may be referred to as "Parties" or individually as a "Party."
1. Purpose
The purpose of this Agreement is to establish a partnership through which the Grower supplies dahlia tubers for sale by the Company. All parties agree to uphold high standards of quality, sanitation, and regenerative agricultural practices where possible.
2. Term
This Agreement shall begin today and remain in effect for one (1) year growing season, automatically renewing annually unless terminated in writing by either Party with 30 days' notice.
3. Tuber Quality and Standards
The Grower agrees to supply to the best of their knowledge only healthy, viable dahlia tubers that meet the following standards:
- Size & Viability: Each tuber must have at least one viable eye and be of commercially acceptable size – Min 2.5" in length and .5" in thickness
- Sanitation: All tubers must be free from any signs of rot, mold, mildew, or signs of disease or pest infestation.
- Shrinkage: Tubers must be fully cured and ideally have no signs of shrinkage. If shrinkage is visible it will be at the company review to determine if it meets the quality standards for an accepted sale.
- Labeling: Each individual tuber must be accurately labeled with variety name, by either an individual tag or a black permanent Garden Marker only written directly on the tuber and must be legible.
- Product Photos: Each different variety must be photographed as per the photo guidelines and uploaded to the Growers online application.
- Packaging: At the time of drop off. All tubers of the same variety must be packaged in the same container and labeled clearly with the variety and quantity on the outside of the container. Each different variety must be in its own container with only the same variety. We do not accept containers with mixed varieties.
- No Chemical Contamination: All tubers must be Bloom confirmed
4. Growing Practices
Grower agrees to follow sanitation and regenerative growing principles where possible and applicable, including but not limited to:
4.1 Sanitation Practices:
- Disinfect all tools, containers, and storage areas used in harvesting, dividing and storing tubers.
- Use disease-free stock and rotate crops to prevent buildup of soilborne pathogens.
- Upon noticing a diseased plant promptly remove and dispose of diseased plant material away from growing areas.
4.2 Regenerative Agriculture Standards:
- Avoid synthetic herbicides, pesticides, and fertilizers. Where possible
- Use compost, organic matter, and cover crops to build soil health.
- Practice no-till or low-till methods to preserve soil structure and microbial life.
- Encourage biodiversity through interplanting or companion planting.
- Limit water use with mulch, drip irrigation, or other water-efficient methods.
5. Pricing & Payment
- Tubers will be purchased at 50% of the online sale price, minus a 3 % shopify Fee
- Payment will be made to growers once per month once the commencement of the online sale begins from March through to end of May. Only sold items will be paid for.
- All unsold tubers will be returned with a pick up location and date TBD. Any tubers not picked up on the specified date and time can be returned to the grower at the growers expense.
- The company may have quantity limits for some varieties once that limit is reached that variety is then closed.
6. Delivery & Inventory
- Grower agrees to deliver tubers to the Company at the drop off location each season. The drop off location will be determined annually with locations, date and time TBC. Alternatively by posting the tubers to us.
- Quantities and varieties must be confirmed and entered into the online site at least 14 days prior.
- At the time of hand over the Company reserves the right to reject any tubers not meeting quality or sanitation standards. This will adjust the quantities available in agreement with the grower. All tubers not meeting the quality standards will be returned
7. Liability & Indemnification
Grower shall be responsible for any losses or damage resulting from Shrivel, rot, breakage and tuber disease, pest contamination, or mislabeling. Grower agrees to indemnify and hold the Company harmless from any claims, losses, or damages resulting from breach of this Agreement. Grower understands that the tubers are perishable in nature and will not hold The Dahlia Tuber Collection responsible for any tuber loss whilst under their care.
8. Termination
This Agreement may be terminated by either Party with 30 days' written notice. Breach of quality or sanitation standards may result in immediate termination at the Company's discretion.
9. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the State British Columbia Canada
10. Entire Agreement
This Agreement contains the entire understanding between the Parties and supersedes all prior agreements, oral or written.
IN WITNESS WHEREOF, the Parties have executed this Agreement as of the Effective Date. A copy of this document will be sent to you as part of your On-Boarding Package
